WINSLOW -- Two men were charged in separate incidents over the weekend after they allegedly resisted arrest and got into physical scuffles with the same police officer.
The first incident was reported Saturday at 12:07 a.m. Winslow patrol Officer Haley L. Fleming responded to 12 Clinton Ave. for a complaint involving loud music from a party, Police Chief Richard Grindall said.
Fleming met with the tenant of apartment 1, Demetrio Bautista, 41, who was at the residence with at least two other people. Bautista started yelling derogatory remarks at the officer, saying he wanted the officer to remove his gun and fight him, Grindall said.
When Fleming tried to place Bautista's hand behind his back, the man resisted and the two got into a brawl outside on the wet grass on the front lawn, Grindall said. During the struggle, Bautista kicked Fleming in the stomach, Grindall said.
The officer deployed his Taser stun gun on the man, sending him to the ground and subduing him for five seconds. But Bautista stood back up again and attempted to approach the officer and was shocked by the Taser a second time, Grindall said.
Fleming then placed Bautista in handcuffs. Winslow Sgt. Paul Morrissette arrived to assist with the arrest.
Bautista was charged with assault, disorderly conduct and refusing to submit to arrest. Back at the Winslow police station, Bautista continued yelling at and threatening the officers, asking to fight Fleming "one on one," Grindall said.
When he was transported to the Kennebec County jail, Bautista "was highly uncooperative" and "had to be taken to ground to reapply handcuffs," Grindall said.
The second incident, reported Sunday at 1:59 a.m., involved a complaint of a man yelling derogatory remarks in the middle of Benton Avenue, across from the Winslow Fire Station. Fleming responded and found the man, Anthony Lee Boutin, 27, of 503 Benton Ave., lying down in the lawn of a nearby residence.
Boutin, who appeared intoxicated, refused to give Fleming his name and started to walk, and then run, away from the officer, Grindall said. Fleming forced Boutin onto the sidewalk and the man continued resisting arrest, Grindall said.
Fleming threatened to shock Boutin with a Taser and Boutin then stopped resisting, Grindall said. Officer Ryan Loubier also assisted at the scene.
Boutin was charged with refusing to submit to arrest and criminal mischief.
Once in custody at the police station, Boutin was "highly disorderly and verbally uncooperative," Grindall said. Asked how much alcohol he had consumed, Boutin stated "37 beers," Grindall said. He was also taken to the Kennebec County jail.
On Monday, Boutin had been released from jail after posting $250 bail. He is scheduled for arraignment July 21 in Waterville District Court.
Bautista was still being held at the jail on $1,250 bail and was scheduled for arraignment by video on Monday afternoon.
Grindall said police will seek restitution in both cases: $85 from Boutin for damages to officer Fleming's pants during the scuffle and $25 from Bautista for use of the Taser cartridge.
